Nuvia Health PLLC adheres to A2P 10DLC requirements including: clear disclosure of opt-in details during the intake process (brand name, message frequency, opt-out/HELP information), STOP instructions and confirmation messages upon opting out, HELP information available by texting HELP or contacting our office, privacy assurance that opt-in data is never shared with third parties for marketing purposes, and ensuring all messages identify the brand and include opt-out instructions.

Third-party service providers

We use Mailchimp (The Rocket Science Group LLC), a third-party email and marketing platform, to manage our mailing list and deliver email communications. When you provide your information through our signup form, your name, email address, and phone number may be stored and processed by Mailchimp on our behalf. Mailchimp's privacy practices are governed by their own privacy policy, available at intuit.com/privacy/statement.

We use Healow, a third-party messaging platform, to facilitate two-way text messaging, appointment reminders, and patient communications. Your name, phone number, and message interactions may be processed by Healow on our behalf.

Our responsibilities

Nuvia Health is required by law to maintain the privacy of your protected health information (PHI), provide you with this Notice of our legal duties and privacy practices, and notify you in the event of a breach of your unsecured PHI.

Messaging Privacy Policy

This Messaging Privacy Policy explains how Nuvia Health PLLC ("Nuvia Health," "we," "us," or "our") collects, uses, and protects information related to text (SMS/MMS) messaging. It supplements our Privacy Policy and the SMS & Messaging Terms of Service in our Terms & Conditions.

Information we collect

When you provide your mobile phone number and consent to receive text messages, we collect your mobile number, the content of messages you send to us, and basic delivery information (such as timestamps and delivery status) needed to operate the messaging program.

How we use your information

We use your mobile number and message information only to send and respond to the messages you have consented to receive — including appointment reminders, account notifications, surveys, and other service-related updates — and to provide support when you reply HELP.

How we share your information

We do not sell, rent, or share your mobile phone number or text messaging consent with third parties or affiliates for their marketing or promotional purposes. We share your information only with service providers that help us deliver text messages (such as our messaging platform and carriers), and only to the extent needed to operate the messaging program. These providers are contractually required to protect your information.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Opt-out

You may opt out of receiving text messages at any time by replying STOP to any message. After you opt out, you will receive a confirmation message and no further messages will be sent unless you re-enroll. For help, reply HELP to any message or call (903) 310-3231.

Protected health information

Standard text messages are not a secure or encrypted channel. We limit the health information included in text messages and ask that you not send sensitive or urgent medical information by text. Our handling of protected health information is also governed by our Notice of Privacy Practices.

Consent is not a condition of care

Consent to receive text messages is not a condition of receiving healthcare services.

Changes to this policy

We may update this Messaging Privacy Policy from time to time. Changes will be posted on this page with an updated effective date.
